SB 192 Summary

• Enacts the Validating Act of 2012 to validate the organization, boundaries, acts, proceedings, and bonds of California state and local public bodies including counties, cities, districts, and specified agencies.

• Confirms that all public bodies previously organized under law are legally functioning and possess all rights, powers, and privileges of regularly formed entities.

• Validates all past acts and proceedings related to territorial changes (annexation, detachment, consolidation, merger, dissolution) and bond issuance by any public body.

• Establishes a six-month statute of limitations from the act's effective date (September 7, 2012) for challenging the validity of public body formation, boundary changes, or bond issuance; after which all such matters become legally valid and incontestable.

• Excludes community redevelopment agencies and related joint powers authorities from validation protections and does not apply to matters already determined illegal or currently pending in litigation.
