SB 443 Summary

• Eliminates requirement for additional pleading or proof regarding prior convictions, enhancements, or sex offender registration status that make defendants ineligible for county jail sentences.

• Requires persons convicted of felonies while on mandatory supervision to serve remaining mandatory supervision time and new prison sentences in state prison.

• Subjects persons sentenced to mandatory supervision with suspended county jail time to warrantless searches of their residence and possessions by county agencies or peace officers.

• Terminates postrelease supervision jurisdiction upon a new criminal conviction resulting in a prison sentence of 3 years or longer, and excludes time in custody for violations from credits toward discharge deadlines.

• Changes firearm enhancement for drug trafficking offenses under Health and Safety Code sections 11351-11379.6 from county jail to state prison for terms of 3, 4, or 5 years.
