AB 1001 Summary

• Extends the exemption for packaging containing recycled materials with regulated metals from January 1, 2010 to January 1, 2017, allowing manufacturers and suppliers additional time to comply with hazardous materials restrictions.

• Requires manufacturers or suppliers claiming the recycled materials exemption to coordinate with the Department of Toxic Substances Control by July 1, 2014 to develop studies measuring regulated metal content and leaching from the packaging.

• Mandates manufacturers or suppliers submit study results to the department by July 1, 2015 and reimburse the department for actual costs associated with coordinating and reviewing the studies.

• Changes documentation submission requirements from biennial updates to twice-yearly submissions on or before July 1 and January 1 of each year the exemption is utilized, and expands the information required in such documentation.

• Takes effect immediately as an urgency statute to facilitate beverage container recycling material studies.
