AB 1309 Summary

• Exempts professional athletes hired outside California and their employers from state occupational disease and cumulative injury workers' compensation provisions if the athlete is temporarily in the state and covered by out-of-state workers' compensation insurance.

• Defines "professional athlete" as athletes employed at minor or major league level in baseball, basketball, football, ice hockey, or soccer.

• Deems an athlete "temporarily within the state" if performing less than 20% of duty days in California during the preceding 365 consecutive days.

• Removes exemption if the athlete has worked 2+ seasons for a California-based team or 20%+ of duty days in California AND worked fewer than 7 seasons for non-California teams.

• Applies to all workers' compensation claims filed on or after September 15, 2013; effective October 8, 2013.
