AB 1426 Summary

• Reorganizes and consolidates tribal gaming provisions in California Government Code by moving scattered sections (12012.5 through 12012.90) into a new Title 16.5 with nonsubstantive technical changes that conform to Governor's Reorganization Plan No. 2 of 2012.

• Ratifies all existing tribal-state gaming compacts negotiated under the federal Indian Gaming Regulatory Act of 1988, including compacts executed from August 1998 through July 2012 covering 57+ California Indian tribes.

• Establishes the Indian Gaming Revenue Sharing Trust Fund and Indian Gaming Special Distribution Fund in the State Treasury to receive and distribute gaming revenues from tribes, with priority uses including shortfall payments to noncompact tribes, gambling addiction programs, regulatory costs, and local government agency support.

• Creates Indian Gaming Local Community Benefit Committees in each county with tribal gaming to distribute grants from Individual Tribal Casino Accounts to local jurisdictions based on a four-part nexus test measuring geographic proximity to tribal casinos, with 60% for nexus grants and 40% for discretionary grants.

• Repeals Chapter 7.5 of Part 2 of Division 3 of Title 2 and makes the local government grant distribution provisions effective only until January 1, 2021, unless extended by later legislation.
