AB 1438 Summary

• Prohibits persons convicted of sexual intercourse, sodomy, oral copulation, or sexual penetration with a child 10 years of age or younger from obtaining a certificate of rehabilitation that would relieve them of sex offender registration duties.

• Prohibits persons convicted of aggravated sexual assault of a child from obtaining a certificate of rehabilitation that would relieve them of sex offender registration duties.

• Imposes lifetime parole (instead of parole for remainder of life only upon sentencing) on persons convicted of aggravated sexual assault of a child or sexual offenses against children 10 years of age or younger.

• Specifies that even if such offenders obtain a certificate of rehabilitation through other means, they remain required to register as sex offenders and register for any future sex offenses committed.

• Effective August 25, 2014.
