Department of General Services must lease vacant property at California State Prison at Folsom to the Old Guard Foundation, Inc., or similar nonprofit entity for construction and operation of a peace officers memorial and museum facility.

Lease term cannot exceed 50 years, and lessee must initiate construction within 48 months and substantially complete it within 72 months of lease start.

Lessee is fully responsible for maintenance, operation, utilities connections, and all costs; state has no liability for improvements or operations and property reverts to state if abandoned or no longer needed for memorial purposes.

Museum facility may include museums, conference rooms, classrooms, exhibits, workshops, secure storage, parking, gift shop, and dining areas.

Department of General Services must conduct periodic reviews every five years to ensure the lease purposes are being carried out.
