AB 1577 Summary

• Requires death certificates to record the decedent's sex to reflect their gender identity, effective July 1, 2015.

• Gender identity shall be reported by the informant unless the person completing the certificate is presented with a birth certificate, driver's license, Social Security record, court order, passport, advanced health care directive, or proof of clinical gender transition treatment.

• If no qualifying documents are presented and persons with equal rights to control the remains disagree with the reported gender identity, those persons may report the gender identity instead, or any one may petition the court to determine who decides.

• Provides immunity from liability for damages or costs arising from claims related to the sex entered on the death certificate when completed in compliance with these requirements.

• Known as the Respect After Death Act.
