AB 1585 Summary

• Allows defendants convicted of solicitation or prostitution to petition courts for relief if they can prove by clear and convincing evidence the conviction resulted from being a human trafficking victim.

• Court orders granting relief must find the defendant was a trafficking victim, dismiss charges or order other relief, and notify the Department of Justice.

• Excludes conviction records for which trafficking relief has been granted from criminal records disseminated for employment, licensing, certification, and adoption background check purposes.

• Amends Family Code sections 8712, 8811, and 8908 to prevent use of excluded trafficking-related convictions in adoption agency evaluations of prospective adoptive parents.

• Modifies Penal Code Section 11105 to exempt trafficking relief convictions from criminal history information provided to various agencies and employers.
