AB 1775 Summary

• Expands the definition of sexual exploitation under the Child Abuse and Neglect Reporting Act to include knowingly downloading, streaming, or accessing through electronic or digital media any film, photograph, videotape, or similar material depicting a child engaged in obscene sexual conduct.

• Adds downloading, streaming, and digital access to the existing prohibited activities of depicting, developing, duplicating, printing, or exchanging child sexual abuse material.

• Maintains exceptions for law enforcement and prosecution agencies and other persons authorized under Penal Code Section 311.3.

• Imposes state-mandated local program requirements on agencies and school districts to enforce the expanded definition, with reimbursement procedures established through the Commission on State Mandates if applicable costs are determined.

• Approved by Governor on August 22, 2014 and filed with Secretary of State the same day.
