Requires all sharps sold to the general public in California in quantities of 50 or more to include a free sharps waste container that meets state and federal standards, provided by the manufacturer at no cost.

Sharps waste containers must be labeled with "sharps waste" or the international biohazard symbol and include directions for safe disposal and references to the Department of Resources Recycling and Recovery's disposal resources.

Does not preclude manufacturers from implementing voluntary take-back or mail-back programs for home-generated sharps waste, and does not preempt local ordinances establishing mandatory sharps waste collection systems.

Encourages the administrative director of the Division of Workers' Compensation to review practices for identifying and reporting needlestick injuries caused by sharps waste in nonhealth care occupations to improve data collection accuracy.

Specifies that no state reimbursement is required because costs incurred by local agencies or school districts result from creating a new crime.
