AB 2034 Summary

• Requires conservators of elders or dependent adults to notify relatives when the conservatee dies or is admitted to acute care for 3+ days, and to inform relatives of funeral arrangements and final resting place in case of death.

• Allows first-degree relatives of elders or dependent adults to petition courts for visitation orders to prevent isolation, without requiring conservatorship.

• Court may appoint counsel to represent the proposed visitee if they lack legal representation, with reasonable fees paid by the non-prevailing party or county if unable to pay.

• Creates a new civil cause of action with hearing procedures requiring 60-day scheduling, 21-day notice to parties, and visitation orders lasting up to 5 years and renewable.

• Becomes operative January 1, 2016 and repeals January 1, 2019 unless extended by later legislation.
