AB 2090 Summary

• Replaces "Level of Service C or D" requirements with flexible performance measures (such as speed or travel times) for HOT lanes in San Diego and Santa Clara counties, established with Department of Transportation consent.

• Permits high-occupancy vehicles using HOT lanes to be required to have electronic transponders or other electronic devices for enforcement purposes.

• Expands authorized uses of HOT lane toll revenues to include "transportation corridor improvements" in addition to existing uses for transit service improvements and HOT vehicle facilities.

• Applies changes to three HOT lane programs: SANDAG's I-15 corridor, SANDAG's two additional San Diego County corridors, and Santa Clara Valley Transportation Authority's two state highway corridors.

• Maintains annual departmental audits of HOT lane performance and requires three-year legislative reports on program findings and effects on adjacent traffic lanes.
