AB 2149 Summary

• Exempts the County of San Diego from competitive bidding requirements under the Local Agency Public Construction Act for contracts with private entities to deliver a regional communications system and related infrastructure for public safety agencies and emergency responders in San Diego and Imperial Counties.

• Allows the County of San Diego to use any competitive procurement method for procuring the regional communications system, including methods not otherwise available under the act.

• Requires the county to use "best value" procurement if it does not use a procurement method already available under the act, with best value defined as evaluation based on price, functional specifications, technical specifications, implementation plan, life-cycle costs, experience, past performance, and fiscal stability.

• Permits best value determination through selection of the lowest priced technically acceptable proposal, selection of the best proposal for a fixed price, or tradeoff analysis between price and other specified factors.

• Legislature declares a special law is necessary due to unique public safety needs in San Diego County that cannot be addressed by general law.
