Changes superintendent authority to transfer teachers based on "best interest of pupils" rather than "best interest of the school district" when the superintendent concludes a transfer is necessary.

Allows school districts to deviate from seniority-based termination and reappointment of certificated employees to maintain or achieve compliance with constitutional equal protection requirements "as it applies to pupils."

Declares legislative intent that amendments to Section 35035 regarding teacher transfers shall not apply to public employers or employees covered by collective bargaining agreements that conflict with these provisions.

Makes clarifying language changes throughout Education Code Sections 35035, 44955, 44956, and 44957 regarding employee assignments, terminations, and reappointments.

Declares that amendments to Sections 44955, 44956, and 44957 are declaratory of existing law.
