AB 2310 Summary

• Authorizes city prosecutors or city attorneys in Los Angeles, Sacramento, and Alameda counties to file unlawful detainer actions against tenants engaged in illegal firearms or ammunition activity, effective until January 1, 2019.

• Requires 30 calendar days' written notice to property owners before filing an action, with owners given opportunity to file the action themselves or assign rights to the prosecutor/attorney for costs up to $600.

• Allows courts to order full or partial eviction of violating tenants, but permits courts to dismiss or stay eviction orders if tenant proves by clear and convincing evidence that immediate eviction would cause extreme hardship outweighing community safety concerns.

• Requires participating city attorneys and prosecutors to report detailed data annually to the California Research Bureau regarding notices issued, cases filed, outcomes, and tenant demographics; California Research Bureau must submit evaluation reports to Legislature by March 20, 2016 and March 20, 2018.

• Took effect immediately as an urgency statute upon approval on September 15, 2014.
