AB 2353 Summary

• Exempts projects to expand existing surface water storage facilities or replace them from California Environmental Quality Act (CEQA) requirements if owned and operated by a public entity

• Requires the public entity to adopt findings by resolution at a public meeting that the project meets all specified criteria including supplying water for agricultural and nonagricultural purposes

• Limits expansion projects to no more than 25 percent increase in water storage capacity

• Requires projects to comply with applicable federal and state safety guidelines and be necessary to preserve facility operation or address earthquake-related flood risks

• Does not exempt projects from compliance with other applicable state or federal laws and regulations
