AB 2632 Summary

• Prohibits the State Department of Social Services from issuing criminal record clearances to individuals arrested for specified crimes (sex offenses, violence-related crimes, etc.) until the department completes an investigation to determine if the person poses a risk to facility clients.

• Requires facilities to obtain criminal record clearances or exemptions from the department for specified individuals prior to employment, residence, or initial presence in licensed community care facilities, foster homes, residential care facilities, and child day care facilities.

• Establishes that the department cannot use arrest records alone to deny clearances or employment without investigating the incident and securing admissible evidence that the person may pose a risk to client health and safety.

• Extends post-licensure criminal background check requirements to ensure ongoing screening of employees and residents at care facilities for vulnerable populations including children, elderly, and chronically ill persons.
