AB 352 Summary

• Requires group homes, foster family agencies, small family homes, transitional housing placement providers, and crisis nurseries to maintain smoke-free environments in residential facilities

• Prohibits licensed or certified persons providing foster family home or certified family home care from smoking or allowing others to smoke inside the facility and on outdoor grounds when children are present

• Prohibits licensed or certified persons from smoking in motor vehicles regularly used to transport foster children

• Violations are enforceable under existing California Community Care Facilities Act provisions, making violations a misdemeanor

• No state reimbursement required to local agencies or school districts as costs result from creating new crime-related penalties under existing law
