SB 1040 Summary

• Requires labeling of genetically engineered (GE) foods sold in California beginning January 1, 2016, with labels reading "Genetically Engineered" or "Produced with Genetic Engineering"

• Applies to raw agricultural commodities and packaged foods that are entirely or partially produced through genetic engineering, and designates such unlabeled foods as misbranded under state law

• Exempts alcoholic beverages, foods from businesses with 10 or fewer employees, certified farmers markets, field retail stands, farm stands, and foods where GE materials account for less than 0.9% of total weight

• Imposes labeling requirements on manufacturers and retailers; provides liability protections for those who rely in good faith on supplier representations that products are not genetically engineered

• Creates exceptions for foods certified organic under federal law and foods produced without knowledge or intent to use genetic engineering, verified through independent testing and segregation
