SB 1087 Summary

• Increases farm labor contractor license fee from $500 to $600 effective January 1, 2015, with the $100 increase dedicated to funding the Farm Labor Contractor Enforcement Unit and License Verification Unit.

• Prohibits granting or renewing a farm labor contractor license to anyone found by a court or administrative agency to have committed sexual harassment within the preceding 3 years, or who employed supervisors known to have committed sexual harassment during that period.

• Authorizes the Labor Commissioner to revoke, suspend, or refuse to renew a license based on sexual harassment violations by the licensee or their supervisory employees within the preceding 3 years.

• Requires farm labor contractors to complete 9 hours of annual educational classes (increased from 8 hours), including at least 1 hour of sexual harassment prevention training, and mandates supervisory employees receive 2 hours of sexual harassment prevention training annually.

• Increases the penalty for operating as a farm labor contractor after license suspension, revocation, or denial from $1,000-$5,000 to a minimum fine of $10,000, with possible imprisonment of 6 months to 1 year.
