Reduces the amount of marijuana that must be retained before destruction from 10 pounds to 2 pounds for growing or harvested marijuana plants.

Requires law enforcement to retain at least one 2-pound sample and 5 random representative samples of marijuana (consisting of leaves or buds) for evidentiary purposes before destroying the remainder.

Maintains existing requirements that at least 5 random and representative samples be taken from other controlled substances exceeding 10 pounds in gross weight before destruction.

Allows destruction of seized marijuana without a court order once sampling and documentation requirements are met, with an affidavit to be filed within 30 days in the appropriate court.
