SB 1244 Summary

• Extends the operation of the Structural Pest Control Board within the Department of Consumer Affairs from January 1, 2015 to January 1, 2019.

• Defines "pesticide" to include spray adjuvants and substances intended to prevent, destroy, repel, or mitigate pests; changes applicator's license expiration date to June 30 of the third year after issuance rather than three years from issuance date.

• Authorizes use of pesticide stamp numbers in addition to pesticide stamps for monthly pesticide use reports; eliminates requirement to specify number of applications made in reports; requires licensees to maintain copies of reports for 3 years.

• Establishes a 2-year statute of limitations for actions against structural pest control licensees or registered companies for violations, or 1 year from submission of a completed investigation by an agricultural commissioner.

• Authorizes waiving the use of warning agents with fumigants in specified circumstances such as for sensitive items in museums or police evidence storage, provided alternative safety precautions are documented and approved by the state regulatory authority.
