SB 1255 Summary

• Amends Penal Code Section 647 to make it a misdemeanor to intentionally distribute intimate images or sexual act images of another identifiable person when both parties understood the image would remain private, the distributor knows distribution will cause serious emotional distress, and the victim suffers that distress.

• Defines "intimate body part" as any portion of genitals, anus, or in females, any portion of breasts below the top of areola, whether uncovered or clearly visible through clothing.

• Establishes exceptions allowing distribution if made while reporting unlawful activity, in compliance with a subpoena or court order, or during a lawful public proceeding.

• Defines intentional distribution to include personally distributing the image or arranging, requesting, or intentionally causing another person to distribute it.

• Contains operative provisions that coordinate with AB 1791 and SB 1388 if those bills are enacted before January 1, 2015.
