SB 1261 Summary

• Transfers authority to specify hazardous materials inventory requirements from unified program agencies to the Secretary for Environmental Protection in coordination with the Office of Emergency Services.

• Modifies business plan submission requirements from triennial (every 3 years) to annual submissions, with annual certification by business owners/operators that information is complete and accurate.

• Exempts unstaffed facilities located at least one-half mile from nearest occupied structures from certain business plan requirements, requiring only a one-time submittal without emergency response plan and training elements.

• Allows unified program agencies to adopt ordinances designating non-listed materials as hazardous materials if reasonable basis exists that material would be injurious to health or environment.

• Requires the Office of Emergency Services to adopt regulations by January 1, 2016 for reporting releases or threatened releases of hazardous materials.
