SB 1340 Summary

• Prohibits health care service plans and health insurers from including contract provisions that restrict furnishing consumers or purchasers with information about cost ranges of procedures or full courses of treatment and quality of services provided by providers or suppliers, effective January 1, 2015

• Requires plans and insurers to provide providers and suppliers 30 days advance notice to review the methodology and data used before disclosing cost or quality information to consumers or purchasers

• Mandates that plans and insurers display a prominent disclaimer on websites stating that factors such as uninsured care costs, procedure severity, case mix, special services, and payer mix may influence cost or quality

• Allows providers and suppliers to provide website links to post responses or rebuttals to cost and quality information displayed by plans and insurers, which must be prominently linked on the plan's or insurer's website

• Makes any contractual provision inconsistent with these requirements void and unenforceable
