SB 1424 Summary

• Grants the City of Martinez trust ownership of four parcels of tidelands in Contra Costa County (Parcels A, B, C, and D) to be held for public benefit consistent with the public trust doctrine, including maritime commerce, navigation, fisheries, and water-oriented recreation.

• Requires the City of Martinez to submit a trust lands use plan to the State Lands Commission by January 1, 2020, for approval before implementing any development or use of the trust lands.

• Mandates the City of Martinez transmit 20% of gross revenues from trust lands to the State Lands Commission beginning June 30, 2015 (80% to General Fund, 20% to Land Bank Fund), with discretionary relief available through June 30, 2021 to address marina deterioration.

• Prohibits the City of Martinez from selling or transferring the trust lands but allows leases up to 49 years for purposes consistent with the public trust, and requires capital improvements exceeding $250,000 to be approved by the State Lands Commission.

• Requires detailed five-year reports on trust lands utilization and annual statements of revenues and expenditures, with reversion of all trust property to the state if the city substantially fails to maintain the lands.
