Establishes the Railroad Tank Car Hazardous Materials Safety Fund in the State Treasury to support emergency response capabilities for railroad accidents involving hazardous materials tank cars.

Imposes a fee on every owner of hazardous material transported by rail in tank cars within California, to be collected by railroads and remitted to the State Board of Equalization.

Requires every person operating a railroad that transports hazardous materials by tank car to register with the State Board of Equalization and remit fees according to the Fee Collection Procedures Law.

Designates collected revenues (minus administrative costs and General Fund reimbursement) to be used by the Department of Toxic Substances Control for planning and maintaining emergency response capabilities for railroad accidents and hazardous material releases, including explosions and fires.

Specifies that no state reimbursement is required to local agencies or school districts under the California Constitution because the bill's only costs stem from creating a new crime related to fee collection violations.
