AB 1063 - Solid Waste: Charges

• Raises the quarterly fee paid by disposal facility operators from a maximum of $1.40 per ton to $4.00 per ton, effective January 1, 2017.

• Requires a minimum of $1.50 per ton of collected fees to be allocated toward activities promoting recycling and best use of materials until January 1, 2022; after that date, all collected fees may be allocated to these purposes.

• Establishes a new quarterly charge on solid waste generators, effective January 1, 2019, collected by local jurisdictions and remitted to the state board, with at least $15 million per calendar year allocated to recycling and material reuse activities until January 1, 2022.

• After January 1, 2022, the solid waste generator charge is calculated to recover departmental costs not covered by facility operator fees, with amounts set triennially.

• Creates a state-mandated local program requiring cities and counties to collect and remit the generator charge, with reimbursement procedures established through the Commission on State Mandates.
