AB 109 Summary

• Authorizes leasing up to 20 additional acres at Fairview Developmental Center for affordable housing for people with developmental disabilities, with proceeds deposited in a new Department of Developmental Services Trust Fund for housing and transitional services.

• Reduces maximum capacity of facilities with secured perimeters from 15 to 6 residents (except forensic competency programs), removes Medicaid eligibility requirement, and limits statewide beds to 150 total; requires individual program planning team meetings every 90 days instead of annually.

• Requires Department of Developmental Services to submit closure plan(s) for one or more developmental centers to Legislature by October 1, 2015, with implementation contingent on legislative approval during 2016-17 budget process.

• Raises minimum age for admission to Porterville Developmental Center secure treatment facility to 18 years old and limits secure treatment population to 211 persons; prohibits juvenile admissions and establishes transitional treatment program with 60-person capacity.

• Appropriates $61,554,000 from General Fund for regional center operations and purchase of services; requires regional centers to provide individual program plans in threshold languages within 45 days and expand data reporting on disparities in service access.
