AB 1289 Summary

• Requires transportation network companies to conduct local and national criminal background checks for each participating driver, including searches of multistate criminal records databases and the U.S. Department of Justice National Sex Offender Public Website.

• Prohibits transportation network companies from contracting with, employing, or retaining drivers who are registered sex offenders, convicted of violent felonies, or convicted of terrorism-related felonies under specified Penal Code sections.

• Prohibits transportation network companies from hiring drivers convicted within the previous 7 years of misdemeanor assault or battery, domestic violence offenses, driving under the influence, or specified felonies related to elections fraud and theft.

• Imposes penalties of $1,000 to $5,000 for each violation or failure to comply with background check requirements.

• Authorizes investigative consumer reporting agencies to furnish criminal history reports to transportation network companies without the standard 7-year limitation on reporting criminal records.
