• Authorizes any person to request an investigation of residential care facilities for the elderly by filing a complaint with the department alleging violations of applicable statutes or regulations.

• Requires the program administrator of the Community Care Licensing Division (rather than the Director of Social Services) to approve citations imposing civil penalties for violations resulting in death, physical abuse, or serious bodily injury.

• Establishes formal review procedures allowing licensees to appeal civil penalty assessments and deficiency findings to a regional manager, then program administrator, with possible further appeal to an administrative law judge for death and physical abuse penalties.

• Requires deficiency notifications to include a factual description fully stating how the licensee failed to comply with specified statutes or regulations, including the particular location of the deficiency within the facility.

• Removes the requirement that penalties collected from child day care centers and family day care homes be used to assist families with identification, transportation, and enrollment of children in alternative care following license revocation or suspension.
