AB 1575 Summary

• Authorizes use of medical cannabis trademark classifications (Classes 500 and 501) for marks registered on or after January 1, 2017, notwithstanding federal Patent and Trademark Office classifications.

• Establishes state track and trace program for medical cannabis movement through distribution chain with unique identifiers; requires State Board of Equalization and Department of Business Oversight to form advisory group on financial services and submit recommendations by July 1, 2017.

• Mandates uniform statewide packaging safety standards set by State Department of Public Health; prohibits local jurisdictions from exceeding these standards while allowing stricter requirements on other health, safety, and security matters.

• Subjects Bureau of Medical Cannabis Regulation to legislative review commencing January 1, 2023; allows cultivators and manufacturers to hold Type 12 transporter licenses; expands license category combinations under specified conditions.

• Requires advertising for medical cannabis licensees to include valid state license number one year after bureau posts notice of licensing commencement; prohibits advertisements depicting cannabis consumption while driving or operating machinery.
