AB 1682 Summary

• Prohibits settlement agreement provisions that prevent disclosure of factual information related to civil actions involving felony sex offenses, childhood sexual abuse, sexual exploitation of minors, or sexual assault against elders or dependent adults.

• Bars courts from entering orders that restrict disclosure of factual information in these types of civil actions, whether by stipulation or otherwise.

• Allows settlement agreements to still restrict disclosure of medical information, personal identifying information, and the nature of the relationship between victim and defendant.

• Voids any confidentiality provisions preventing disclosure of factual information entered into on or after January 1, 2017 as void and against public policy.

• Makes it grounds for professional discipline if an attorney demands confidentiality provisions as a settlement condition or advises clients to sign such agreements, requiring the State Bar to investigate.
