• Distinguishes prostitution offenses based on whether an individual solicits/agrees to receive compensation (seller) versus provide compensation (buyer) to a person 18 years or older.

• Establishes separate penalties for buyers: minimum 72 hours county jail (or 48 hours if probation granted) and $250-$1,000 fine, up to 6 months maximum imprisonment.

• Increases penalties for soliciting minors or those posing as minors: minimum 72 hours county jail (or 48 hours if probation granted) and $1,000-$10,000 fine, up to 1 year maximum imprisonment.

• Exempts children under 18 years old engaged in prostitution from criminal liability, allowing them to be treated as dependent children of the court instead.

• Contains conditional operative clauses dependent on enactment of Senate Bills 1129 and 1322, with different versions of the law applying based on which bills pass.
