AB 1934 Summary

• Requires cities and counties to grant development bonuses to commercial developers who partner with affordable housing developers to contribute affordable housing through joint or separate projects until January 1, 2022.

• Development bonuses may include up to 20-percent increases in density, floor area ratio, or height; up to 20-percent reduction in parking requirements; exceptions to zoning ordinances; or other mutually agreed incentives.

• Commercial developers must partner with housing developers providing at least 30 percent of units for low-income households or at least 15 percent for very low-income households, with the affordable housing located on-site or within the jurisdiction near transit, schools, and employment.

• Affordable housing contributions can be made through direct construction by the commercial developer, donation of property to the housing developer, or cash payments toward construction costs.

• Cities and counties must report approved bonuses to the Department of Housing and Community Development as part of annual reports, including agreement terms and number of affordable units constructed.
