AB 2230 Summary

• Suspends the existing earnings standard (2 times state minimum wage) for overtime exemption of private school teachers until July 1, 2017

• Establishes new earnings requirement effective July 1, 2017 requiring teachers to earn either 100% of the lowest salary offered by any school district for credentialed positions, or 70% of the lowest schedule salary offered by their county's school district

• Maintains existing requirements that exempted teachers must be primarily engaged in teaching, exercise discretion and independent judgment, and hold a baccalaureate degree or valid teaching credential

• Excludes tutors, teaching assistants, instructional aides, student teachers, day care providers, and similar employees from the exemption

• Does not affect other professional, executive, or administrative overtime exemptions established by the Industrial Welfare Commission
