AB 2339 Summary

• Defines "aggregate customer peak demand" for calculating net energy metering program limits for electric utilities with more than 25,000 service connections that are not large electrical corporations, using the highest sum of noncoincident peak demands occurring in any calendar year.

• Requires utilities without access to 15-minute or 30-minute interval data to base aggregate demand calculations on load research studies using standard statistical sampling techniques and a four-year moving average of annual noncoincident peak load data.

• Prevents utilities from decreasing the established aggregate peak demand level below the most recently determined level.

• Provides that utilities already exceeding 5 percent aggregate generating capacity as of January 1, 2016, with an adopted successor tariff are deemed compliant with net energy metering program limits.
