Requires public or private agencies to make position statements available to applicants or recipients at county welfare offices, via U.S. mail, or through electronic means upon request, at least two business days before fair hearings.

Mandates use of secure electronic means for position statement delivery if requested and required by state or federal privacy laws.

Allows postponement of hearings if position statements are not provided at least two business days in advance or are modified, without counting against applicable benefit decision deadlines.

Exempts agencies from electronic delivery requirements if they submit annual reports by December 31 to the State Department of Social Services describing barriers to electronic document provision and steps being taken to address them.

Exemption expires once the statewide electronic case management system becomes operational with capacity to deliver position statements through secure electronic means.
