AB 2350 Summary

• Prohibits middle and high schools from denying English learner students enrollment in core curriculum courses, full course loads, or college-preparatory courses based solely on their English learner classification or English language development assessment scores.

• Defines "standard instructional program" to include at minimum core curriculum courses, courses required for state and local graduation requirements, and courses required for middle school grade promotion.

• Exempts newly arrived immigrant programs from these requirements if the program is designed to remedy academic deficits and reasonably calculated to enable students to achieve parity in the standard instructional program within a reasonable timeframe, consistent with federal law.

• Implements requirements consistent with the federal Equal Educational Opportunities Act of 1974 and the Castañeda v. Pickard court decision regarding English learners' equal participation in standard school instructional programs.

• Establishes state-mandated local program requiring reimbursement through existing statutory procedures if the Commission on State Mandates determines costs are incurred by implementation.
