Authorizes courts to dismiss actions by aggrieved employees seeking civil penalties if, after notice and hearing, the court finds the employee suffered no appreciable physical or economic harm.

Maintains existing provisions allowing courts to award lesser civil penalties than the maximum specified if doing otherwise would result in an unjust, arbitrary, oppressive, or confiscatory award based on facts and circumstances.

Applies to civil actions brought by employees on behalf of themselves and other current or former employees for violations of California Labor Code provisions that would otherwise be enforced by the Labor and Workforce Development Agency.

Requires superior court review and approval of any penalties sought in proposed settlement agreements under this provision.

Does not apply to workers' compensation law penalties under Division 1 or Division 4 of the Labor Code.
