AB 2513 Summary

• Converts a sentencing aggravating factor to a mandatory one-year penalty enhancement for human trafficking convictions when the defendant recruited, enticed, or obtained the victim from a shelter or placement serving runaway youth, foster children, homeless persons, or trafficking/domestic violence victims.

• Requires the enhancement to be served consecutively to any other imposed sentence and can only be imposed if admitted by the defendant or found true by the trier of fact.

• Makes technical conforming changes to sections 236.7, 236.8, 236.10, and 236.11 of the Penal Code relating to asset forfeiture procedures in human trafficking cases involving minors in commercial sex acts.

• Clarifies that no state reimbursement is required because costs are incurred through changes in penalty provisions within existing statutory authorization.
