Prohibits business establishments from using consumer racial profiling, defined as profiling or targeting a person that results in differential treatment based on race or ethnicity and denies or degrades products or services offered to customers.

Specifies that consumer racial profiling includes refusal to serve, removal from premises, segregated seating, requiring additional forms of identification, and surveillance practices based on race or ethnicity.

Assigns the Department of Fair Employment and Housing responsibility for receiving, investigating, conciliating, mediating, and prosecuting complaints alleging violations of the act.

Amends Government Code Section 12930 to add Section 51.14 of the Civil Code to the list of violations the department has jurisdiction to enforce, with remedies and procedures independent of other applicable laws.

Includes conditional operative language that Section 2.5 applies only if both this bill and SB 1442 are enacted and become effective by January 1, 2017, with this bill enacted after SB 1442.
