AB 2799 Summary

• Prohibits operators of Internet websites, online services, applications, and mobile applications designed for preschool and prekindergarten purposes from engaging in targeted advertising, creating pupil profiles outside of educational purposes, or selling/disclosing pupil information without authorization, effective July 1, 2017.

• Requires operators to implement reasonable security procedures to protect covered information from unauthorized access, use, modification, or disclosure, and to delete pupil data upon request from preschools, prekindergartens, or districts.

• Allows limited disclosures of pupil information for preschool and prekindergarten purposes, legal compliance, court orders, safety/security, and through contracted service providers with strict confidentiality requirements.

• Permits operators to use deidentified and aggregated pupil information for product improvement and effectiveness demonstration, and allows adaptive learning and customized early learning uses of pupil data.

• Does not apply to general audience websites or services, Internet service providers, electronic software marketplaces, or interactive computer service providers hosting third-party content.
