AB 287 Summary

• Enacts the Consumer Automotive Recall Safety Act (CARS Act) prohibiting dealers and rental car companies with 34 or fewer loaner/rental vehicles from loaning or renting vehicles subject to manufacturer recalls until repairs are completed, effective within 48 hours of receiving recall notice.

• Requires the Department of Motor Vehicles to include a recall disclosure statement on vehicle registration renewal notices directing owners to www.safercar.gov to check for unrepaired safety recalls.

• Expands warranty reimbursement obligations for vehicle franchisors to include all costs directly associated with disposal of hazardous materials from recall repairs, and clarifies that recall work conducted under federal motor vehicle safety laws constitutes a warranty obligation.

• Authorizes the DMV to suspend or revoke licenses of dealers, transporters, manufacturers, and distributors for violating provisions of the Consumer Automotive Recall Safety Act.

• Exempts the state from reimbursement requirements under Article XIII B of the California Constitution because costs are limited to creating new criminal violations.
