Authorizes individuals employed under a special license in nonprofit sheltered workshops, day programs, or rehabilitation facilities to bring discrimination and harassment claims under California's Fair Employment and Housing Act.

Provides employers with an affirmative defense if they prove by preponderance of evidence that the challenged action was permitted by statute or regulation and necessary to serve employees with disabilities under a special license.

Exempts employers from disability discrimination liability for obtaining a special license or paying individuals with disabilities less than minimum wage pursuant to Labor Code Sections 1191 or 1191.5.

Clarifies that the employee definition exclusion for special license workers was not intended to permit harassment or discrimination against these individuals.
