AB 564 Summary

• Establishes a new income-based parental fee schedule effective July 1, 2016, assessing monthly fees to parents of children under 18 in 24-hour out-of-home care when family income exceeds 200 percent of the federal poverty level.

• Calculates monthly parental fees as a percentage of annual gross income (3-6 percent depending on income level between 201-500+ percent of federal poverty level), capped at the maximum monthly cost of child care or actual service costs, whichever is less.

• Authorizes a credit of one day's monthly parental fee for each day a child spends 6 or more consecutive hours on a home visit, requiring parents to request credits within 60 days.

• Requires parents of children already in care prior to July 1, 2016, to transition to the new fee structure at their next annual recalculation or within 60 days of requesting a department review.

• Deposits all collected parental fees into the Developmental Disabilities Program Development Fund for new program initiatives or to offset General Fund costs, with the fund now requiring legislative appropriation rather than being continuously appropriated.
