Owners and real estate agents are not required to disclose that a property occupant died more than three years before the sale, lease, or rental, or the manner of death.

Owners and agents are not required to disclose that a prior occupant was living with HIV or died from AIDS-related complications.

No cause of action can be brought against owners or agents for failing to make these disclosures.

The Legislature declares its intent to occupy the field of regulation regarding death disclosures and HIV-positive status disclosures in real property transfers.

The bill took effect immediately upon approval on September 24, 2016.
