AB 782 Summary

• Expands the Home Care Services Consumer Protection Act to include home care aide domestic referral agencies, subjecting them to licensure, fees, enforcement actions, and regulation by the State Department of Social Services

• Requires home care aide domestic referral agencies to provide clients with written disclosures about potential employer responsibilities for home care aides, including information about employment taxes, workers' compensation registration requirements, and contact information for the Employment Development Department and IRS

• Allows individuals with valid Alien Registration Receipt Cards or Permanent Resident Cards (in addition to existing identification types) to initiate background examinations for licensure as home care aides, home care organizations, or home care aide domestic referral agencies

• Permits current licensees or employees of department-licensed facilities, certified foster parents, certified administrators, and registered TrustLine providers to transfer existing criminal record clearances or exemptions by submitting identification and a declaration verifying identity under penalty of perjury

• Establishes that no state reimbursement is required because costs incurred by local agencies result from creating new crimes or changing criminal penalties, as specified in Government Code Section 17556
