SB 1054 Summary

• Allows the Department of Corrections and Rehabilitation and county agencies to deduct administrative fees covering actual collection costs (not to exceed 10%) from prisoner wages for restitution, instead of a flat 10% fee.

• Authorizes counties to collect restitution fines and orders from individuals released from county jail without being subject to postrelease community supervision or mandatory supervision, with collection methods established by county boards of supervisors.

• Requires counties electing to collect restitution to coordinate efforts with the Franchise Tax Board.

• Prohibits referral of restitution orders to the Franchise Tax Board if a designated county agency has an existing collection system, objects to Franchise Tax Board collection, and commits to collecting the restitution order.

• Allows crime victims to specify their preferred collecting agency, and requires that preference be honored by the Department of Corrections and Rehabilitation or designated county agency.
